Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") govern your use of the OctaQR dynamic QR code platform ("Service"), operated by Kamocsai Péter e.v. ("Provider", "we", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

OctaQR is a dynamic QR code management platform that allows users to:

  • Create and manage dynamic QR codes with customizable design
  • Change the destination URL of QR codes at any time without reprinting
  • Track scan analytics including device types, geographic locations, referral sources, and usage trends
  • Export QR codes in high-resolution PNG and SVG formats
  • Generate PDF campaign reports
  • Organize QR codes into projects and collaborate with team members

4. Access and Registration

The Service is not available through open registration. Access is granted on an individual basis through custom agreements. Only users who have received explicit authorization from the Provider may use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Pricing and Payment

Service pricing is determined on a per-client basis through individual agreements. The Provider will communicate applicable fees, billing cycles, and payment terms directly to each client before the start of the service.

6. Acceptable Use

You agree not to use the Service for any of the following purposes:

  • Distributing malware, viruses, or other harmful software through QR code destinations
  • Linking to illegal, fraudulent, or deceptive content
  • Sending spam or unsolicited bulk communications
  • Phishing or attempting to collect personal information through misleading QR codes
  • Infringing on intellectual property rights of third parties
  • Any activity that violates applicable local, national, or international laws

The Provider reserves the right to suspend or terminate accounts that violate these rules without prior notice.

7. Intellectual Property

The Service, its design, code, and all associated materials are the intellectual property of the Provider. You retain ownership of the content and assets you upload to the Service (such as logos). By uploading content, you grant the Provider a limited license to process and display that content solely for the purpose of delivering the Service.

8. Data and Analytics

The Service collects scan analytics data, including but not limited to: device type, browser, operating system, country and city (derived from IP address), referral source, and timestamp. This data is used to provide analytics features to users. For details on how personal data is handled, please refer to our Privacy Policy.

9. Service Availability

The Provider aims to keep the Service operational and accessible, but does not guarantee uninterrupted or error-free availability. The Service is provided on an "as-is" and "as-available" basis.

The Provider may perform maintenance, updates, or changes to the Service that could temporarily affect availability. We will make reasonable efforts to notify users of planned maintenance in advance.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the Service.
  • The Provider is not responsible for the content of third-party websites linked through QR codes created by users.
  • The Provider is not liable for damages resulting from unauthorized access to your account if the breach was caused by your failure to protect your credentials.
  • Total liability is limited to the fees paid by the user for the Service during the 12 months preceding the claim.

11. Account Termination

Either party may terminate the service agreement in accordance with the terms of their individual agreement. Upon termination:

  • QR code redirects will cease to function
  • Account data will be retained for a reasonable period (up to 90 days) to allow for data export, after which it will be permanently deleted
  • You may request immediate deletion of your data at any time by contacting us

12. Changes to These Terms

The Provider reserves the right to modify these Terms at any time. Updated Terms will be published on this page with a revised "Last updated" date. Continued use of the Service after changes have been published constitutes acceptance of the modified Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hungary. Any disputes arising from the use of the Service shall be resolved by the competent courts of Győr, Hungary.
